These Terms govern your use of XYZ Prints (www.xyz-prints.com) and any order you place for prints, mounting, scanning/reproduction and related services (“Products”). Please read them before ordering. By placing an order you agree to these Terms.
1. Who we are
The Site is operated by Pedro Duarte Guimarães – FOTOGRAFIA, Unipessoal, Lda. (“XYZ Prints”, “we”, “us”), a fine-art printing studio based in Lisbon, Portugal, part of the XYZ ecosystem (XYZ Books / XYZ Press / XYZ Prints).
- Registered office: Rua Ilha do Príncipe 3A, Armazém E, 1170-182 Lisboa, Portugal
- NIF: 514471182
- E-mail: info@xyz-prints.com
2. Our products are made to order
Almost everything we sell is produced individually to your specification — your uploaded image, printed on the paper, at the size, and with the finishing or mounting you choose. Each order is custom-manufactured for you and is not held in stock. This has one important legal consequence for returns and cancellations — see clause 9 and our Returns & Right of Withdrawal policy.
3. Placing an order
- You build your order using the print configurator: you upload an image, choose paper, size and any mounting, and the Site calculates a price.
- You are responsible for the files you upload — their content, quality, resolution and colour — and for confirming the preview, size and options before paying. Low-resolution files may print soft; we print what you approve.
- Submitting an order and payment is an offer to buy. A binding contract is formed only when we send you an order confirmation and accept the order. We may decline or cancel an order before production (for example if a file is unusable, a price was clearly mis-stated, or we cannot lawfully fulfil it); if we do, you are refunded in full.
4. Prices and VAT
- Prices are shown in euro (€) and, for consumers, include Portuguese VAT (IVA) at the applicable rate (currently 23%).
- Business customers in another EU country with a VAT number validated in VIES may be invoiced under the reverse-charge mechanism (VAT not charged by us; you account for it). Exports outside the EU are zero-rated. The price shown updates to reflect your status and delivery country.
- Shipping is calculated and shown before payment. For items that cannot be shipped at a standard rate (e.g. oversized or large mounted pieces), we provide a separate freight quote after your order — see clause 8.
- We try to keep prices accurate, but if a price is obviously wrong we will contact you before producing the order and you may confirm at the correct price or cancel for a full refund.
5. Payment
- Accepted methods are shown at checkout (which may include MB WAY, bank transfer / Multibanco, and card providers).
- Depending on the method, payment may be authorised at checkout and captured when we begin production, or required up front. We begin production once payment is confirmed (or, for manual methods, once we confirm receipt).
- You will receive the legally required Portuguese invoice (fatura-recibo) for your order. Provide your NIF/VAT number at checkout if you need it on the invoice; it cannot always be added afterwards.
6. Production and turnaround
Typical production time is 5 days before dispatch, depending on size, paper, mounting and current workload. Times are estimates, not guarantees. We will tell you if your order needs longer.
7. Files, colour and quality
- Colour: screens and printers reproduce colour differently. The colours you see on your monitor are a guide and may differ from the final print. We print to professional standards on calibrated equipment but cannot guarantee an exact match to your screen. If colour accuracy is critical, ask us about a proof or test print before ordering.
- Resolution: we print the file you approve. If a file is too low-resolution for the chosen size, the result may be soft — this is not a defect.
- Mounting and finishing are carried out to professional standards; slight, characteristic variation in handmade finishing is normal.
8. Shipping and delivery
- We ship with CTT – Correios de Portugal within Portugal and internationally. Delivery estimates are 2 or 4 business days (PT or international) and are not guaranteed.
- Each print normally ships rolled in a protective tube; small mounted pieces may share a box; large mounted pieces are quoted for freight separately after payment, as the cost depends on dimensions and destination. We will send you that quote and arrange dispatch once it is settled.
- Risk in the Products passes to you on delivery. Please inspect your parcel on arrival and report any transit damage promptly (see the Returns policy).
- You are responsible for providing a correct, complete delivery address. Customs duties or import taxes on international orders are your responsibility.
9. Cancellations and right of withdrawal
Because our Products are made to your specification / clearly personalised, they are exempt from the 14-day right of free withdrawal under Decreto-Lei n.º 24/2014, de 14 de fevereiro (Art. 17.º n.º 1 al. c)). In practice, once you have approved and paid for a custom order and it has entered production, it cannot be cancelled for a refund simply because you change your mind. This does not affect your rights if a Product is faulty, damaged or not as described. Full details — including any standard (non-personalised) items and how to claim for faults — are in our Returns & Right of Withdrawal policy, which forms part of these Terms.
10. Legal guarantee of conformity
As a consumer you benefit from the legal guarantee of conformity under Decreto-Lei n.º 84/2021 — currently three (3) years for movable goods. If a Product does not conform to the contract (e.g. a manufacturing defect, the wrong item, or damage that was present on delivery), you are entitled to have it repaired or replaced, or to an appropriate price reduction or refund, as provided by law. See the Returns policy for how to claim.
11. Intellectual property
- Your artwork stays yours. You retain all rights in the images you upload. By placing an order you confirm that you own or are authorised to reproduce the image, and you grant us a limited licence to use it only to produce, pack, ship, reprint and keep fiscal/order records for your order. We do not use your images for marketing, display or any other purpose without your separate permission.
- You are responsible for rights and content. You must not upload images you have no right to reproduce, or content that is unlawful. We may refuse or cancel any order that appears to infringe third-party rights or the law, and you indemnify us against claims arising from the content you supply.
- Our content — the Site, its design, text, configurator and branding — belongs to XYZ Prints / the XYZ ecosystem and may not be copied without permission.
12. Liability
Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, fraud, or your statutory consumer rights). Subject to that, we are not liable for losses that were not reasonably foreseeable, for business losses, or for matters outside our reasonable control. Our total liability for an order is limited to the price paid for that order, except where the law provides otherwise.
13. Your data
We process personal data as described in our Privacy Policy, and use cookies as described in our Cookie Policy.
14. Complaints and dispute resolution
- Please contact us first at info@xyz-prints.com — we aim to resolve any problem quickly.
15. Governing law
These Terms and any order are governed by Portuguese law. Mandatory consumer-protection rules of your country of residence continue to apply. The courts of Portugal have jurisdiction, without prejudice to a consumer’s right to bring proceedings in the courts of their own domicile.
16. Changes
We may update these Terms; the version in force is the one published on the Site when you order. We will post changes here and update the date above.
